The Supreme Court on Tuesday acquitted a person who was sentenced to death in the murder of a 23 -year -old software engineer of Andhra Pradesh. A bench of Justice BR Gawai, Prashant Kumar Mishra and KV Vishwanathan said that it would be extremely insecure to maintain conviction against Chandrabhan Sudam Sunap on the basis of available evidence. The court said that there are many flaws in the prosecution story.

A 23 -year -old software engineer from Machilipatnam in Andhra Pradesh returned to Mumbai on January 5, 2014 after Christmas holiday. He was last seen alive after getting off the train at Mumbai’s Lokmanya Tilak Terminal. After several unsuccessful attempts to contact him on cellphone, his father lodged a complaint of his disappearance. After this, the police started searching for him.

After a search operation that lasted for about 10 days, a burnt and rotted body was found in the bushes near the Eastern Express Highway in Kanjur Marg area. After this, on the basis of the evidence found during the investigation, the Crime Branch of Mumbai Police arrested Chandrabhan Sudam Sunap on charges of rape and murder with the student. During the trial on him, the court sentenced him to death, which he challenged in the High Court.

The Bombay High Court also upheld the decision to hang him. But the Supreme Court, bypassing the decision, said that the circumstances that were trusted, they cannot be made the only hypothesis to be guilty. All facts bind to conclude that there are many flaws in the prosecution story. There is much more than what is seen in this case.

A bench of three judges said that the prosecution has failed to prove their case beyond appropriate doubt. This is the reason why we are bound to reach the only conclusion that the appellant is not guilty of crimes for whom he has been accused. In the year 2015, the court sentenced him to death for the rape of a woman working in a major IT firm in Mumbai.

According to the prosecution, on 5 January 2014, the victim reached the Lokmanya Tilak Terminal in Mumbai from her original residence in Andhra Pradesh after spending some time with her family. At 5 am, she met Chandrabhan Sudam Sunap outside the station. He offered him to leave him to the WWCA hostel in suburban Andheri on his motorcycle instead of Rs 300, where the victim lived.

The victim agreed to go with her, but on the way the accused took her to a secluded place near Kanjur Marg. There he raped her. After this he was brutally killed. Not only this, the accused partially burnt his body and threw him into the bushes near the Eastern Express Highway. On January 14 the same year, the body of the victim was found by her family.
