Why were the by-election dates not announced in October?
Earlier in October, by-election could not be announced on this seat. The Election Commission had argued that the schedule has not been released for the seats for which election petitions have been filed in the court. In fact, after the results of the 2022 assembly elections, BJP candidate Gorakhnath Baba had filed a petition in the Allahabad High Court and appealed to cancel the nomination of Awadhesh Prasad. Gorakhnath Baba’s argument was that the license of the advocate who had certified Awadhesh’s notary affidavit had expired. Therefore, the nomination papers of Awadhesh Prasad should be canceled and I should be declared the winning candidate. As per the instructions of the Supreme Court, it is mandatory for the notary advocate to hold a valid license on the day of document authentication.
‘The order will be uploaded in a day or two’
However, after the ECI press conference, former BJP MLA from Milkipur Assembly seat Gorakhnath Baba approached the Allahabad High Court and requested to withdraw his petition.
