Amid reports of bail for all four accused in the murder case of Khalistani terrorist Hardeep Singh Nijjar, a British Columbia court has ordered the detention of four Indian citizens. Now this case will be heard next month in February.

The accused will have to be present for a case management conference on February 11, 2025. Pre-trial applications will be considered and trial dates are expected to be set early in the new year.

All the accused are in custody

Detention orders imposed by the court ensure that the accused remain in custody until the trial begins. However, a judge may later review the bail petition. But due to serious charges of murder and conspiracy, the chances of bail are less.

Addressing the recent reports of the accused being released, Seymour on Thursday clarified that they (the accused) are still in custody.

According to Seymour, all four accused persons are in custody under mandatory detention orders imposed by a British Columbia court. At present, no bail hearing has been scheduled for the accused and they remain in jail.

Custody records show that the accused were not in custody before a new statement, so clarification is needed on this matter. Whereas the custody status of the accused was shown as ‘N’ in the court records. Which shows that he was not detained. However, Seymour’s statement confirms that the accused remain in custody.

At the same time, this case highlights the complexity of the legal terms used to define custody within the British Columbia justice system.

Tension in relations between India and Canada

Let us tell you that diplomatic relations between India and Canada have remained tense since the murder of Hardeep Singh Nijjar. Former Canadian Prime Minister Justin Trudeau had alleged the involvement of Indian government agents in Nijjar’s murder. However, India rejected Trudeau’s claims as absurd and politically motivated.

At the same time, India has been accusing Canada for a long time of providing safe haven to elements and supporters of Khalistan movement. Due to this issue, diplomatic relations between the two countries have reached the lowest level.

MEA rejects Canada’s allegations

India’s Ministry of External Affairs criticized Canada for failing to provide concrete evidence or formal communication regarding the murder despite the arrest of Indian nationals in connection with the case.

Apart from all this, the Integrated Homicide Investigation Team (IHIT) in British Columbia, which is investigating the Nijjar murder case, has accused the accused of murder and conspiracy to murder. However, Canadian authorities have not publicly presented any evidence to prove claims of an Indian link, despite ongoing media speculation.
