A special court in Balasore district of Odisha on Saturday convicted a 40-year-old man in a rape case and sentenced him to 20 years of imprisonment. The culprit had raped a five-year-old girl when she was going to a shop near her house to buy soap. Based on the complaint of the mother of the victim girl, the police had registered a case against the accused under Section 376 (AB) of the IPC and POCSO Act.
According to the information, this incident happened on May 3 this year. The girl’s mother had sent her to a nearby shop. According to the prosecution, the accused person caught hold of him on the way. He lured him with some food and took him with him. Made her a victim of his lust at a deserted place. After the incident the girl somehow reached her home. He narrated the ordeal of his family members. He took him to the police station.
Special Public Prosecutor Pranab Kumar Panda said that the accused has been convicted under section 376 (AB) of the IPC, which deals with rape of a female below 12 years of age. Along with this, he has also been convicted under the Protection of Children from Sexual Offenses Act. The special POCSO court of Judge Ranjan Kumar Sutar sentenced him to 20 years imprisonment and also imposed a fine of Rs 5,000.
The court has also directed the District Legal Services Authority (DLSA) to pay a compensation of Rs 4 lakh to the victim. He was admitted to the ICU of SCB Medical College and Hospital, Cuttack. The police had arrested the accused.
This incident took place in Trisulia area of Cuttack. The victim’s family lived in a temporary shelter built at a brick kiln. His parents worked at a brick kiln. The accused also used to work there. The accused reached the victim’s house at night in the absence of her family members. He forcibly took her to an isolated place and made her a victim of his lust. The accused had committed so much cruelty that the condition of the victim deteriorated.
The victim’s father lodged his complaint at Barang police station, on the basis of which the police registered a case against the accused under relevant sections of the Indian Justice Code and POCSO Act. Cuttack DCP Jagmohan Meena said that the accused and the girl’s family are residents of Jharkhand. After registering the case, three police teams were formed to arrest the accused.
