The Delhi High Court on Friday extended by three days the interim bail of expelled BJP leader Kuldeep Sengar, who is serving a 10-year jail sentence in the case of custodial death of Unnao rape victim’s father.

Justice Manoj Kumar Ohri, hearing Sengar’s plea seeking extension of interim bail on medical grounds, adjourned the case to December 23 after he was informed that a division bench of the high court had also taken a similar view in the main Unnao rape case. Hearing the petition.

“Notify again on Monday (December 23). Till then the interim bail is extended on the same previous conditions,” the judge said. Justice Ohri was informed that the case is also listed before the division bench on Friday and orders are awaited.

A bench of Justices Pratibha M Singh and Amit Sharma during the day’s hearing in the main Unnao rape case considered the medical report submitted by AIIMS regarding Sengar’s health and remarked that it would extend Sengar’s interim bail by four weeks. . The AIIMS report said that the necessary surgery was done after Sengar was evaluated by a team of doctors.

Senior counsel appearing for Sengar sought extension of the interim bail by five months to ensure necessary care and further treatment. He said, ‘He should be kept in a place where there is no infection. He may lose his sight.’

According to PTI, the division bench on December 5 had directed to temporarily suspend his sentence till December 20. In view of the similar relief granted to Sengar by the division bench in the rape case, the single judge suspended his sentence in the custodial death case till December 20 and granted him interim bail for 10 days.

The division bench ordered Sengar to be admitted to AIIMS, New Delhi for a comprehensive review of his medical condition. On December 20, 2019, he was convicted of raping the minor victim and sentenced to imprisonment for the rest of his life. Sengar’s appeal challenging the trial court’s decision in the rape case is pending in the High Court.

He has sought to quash the trial court’s December 16, 2019 verdict convicting him in the rape case. Sengar also demanded cancellation of the punishment order in the rape case. It is noteworthy that in the year 2017, a minor girl was kidnapped and raped.

On March 13, 2020, Sengar was sentenced by the trial court to 10 years of rigorous imprisonment, along with a fine of Rs 10 lakh, in the case of custodial death of the rape victim’s father. The trial court said that no leniency can be shown for the murder of the sole breadwinner of a family.

The girl’s father was arrested under the Arms Act at the alleged behest of Sengar and died in custody on April 9, 2018 due to police brutality.
