In 2019, a person has been sentenced to 10 years rigorous imprisonment for kidnapping and raping a one -year -old girl. The court said that the hatred of the society towards sex criminals should be reflected in the decisions of the courts.
Additional Sessions Judge Manoj Kumar was listening to a debate on the sentence against the accused. In December last year, he was convicted for sexual harassment under the respective sections of BNS and Poxo Act on charges of rape and kidnapping. In its judgment, the court said that the Poxo Act was enacted in view of a dangerous increase in crimes against children.
The judge said, “The hatred in the society towards sexual criminals targeting children should also be reflected in the decisions of the courts.” He said that the reason for the less punishment in this case is that the criminal is young and he can be rectified. Apart from this, his previous history is clean and tidy. It is not visible in a position to become a threat to the society.
The court then sentenced the culprit to three years rigorous imprisonment for 10 years rigorous imprisonment and kidnapping crime under Section 6 of the Poxo Act. Both decorating will run together. The court said that the purpose of the criminal justice system is not only to provide relief to the culprit by giving him a proportional punishment, but also to rehabilitate the victim forever.
Let us tell you that on February 18, the court sentenced the culprit to 25 years in a rape case. In the year 2012, a criminal has also been fined five thousand for rape of a 2 -year -old girl. In the court, the defense had argued that he was drunk while committing the crime. On this, the judge said that being in a state of intoxication cannot save the crime.
Additional Sessions Judge Babita Punia was listening to arguments against the 26 -year -old accused. He then convicted him under the related sections of the IPC and Poxo Act. Special Public Prosecutor Shravan Kumar Bishnoi said that the guilty is not entitled to any kind of softening for this heinous act. The court said in its judgment that the convict is sentenced to 25 years.
The court also said in its judgment that the duration of punishment will provide proper vengeance and adequate protection to the society. Will make the convict realize the seriousness of his act. The court noted the argument of the defense counsel that the crime was not pre -planned. The court said, “Of course, the guilty was drunk at the time of crime. But it is not a factor to reduce punishment.”
