Delhi High Court has granted 10 days interim bail to former BJP leader Kuldeep Sengar, convicted in the case of custodial death of Unnao rape victim’s father. Justice Manoj Kumar Ohri partially allowed Sengar’s plea and temporarily suspended his sentence.
The court was told that Sengar had filed a petition for postponement of sentence in the division bench of the High Court due to his medical condition. The Division Bench on December 5 directed to postpone the sentencing till December 20.
Delhi High Court grants bail to Kuldeep Sengar
Taking cognizance of this order, Justice Ohri directed to release Sengar on a personal bond of Rs 50,000 and surety of the same amount. Also implemented all the conditions imposed by the Division Bench.
The Division Bench had directed that Sengar be admitted to AIIMS Hospital in Delhi the next day after his release, where his medical condition will be comprehensively reviewed. The medical board will report on his condition and tell in what time his complete treatment can be done.
Sengar is guilty of raping a minor
At the same time, on this occasion, Sengar said that in the POCSO case, interim bail was granted by the High Court by interim suspension of the sentence for two weeks on medical grounds. But in the case of custodial death, he could not come out of jail because the sentence order was not suspended.
Sengar had demanded postponement of sentence for 5 months. His lawyer argued that he has been in jail for 8 years whereas he has been sentenced to a maximum of 10 years in this case. Sengar was sentenced to life imprisonment in 2017 for raping a minor girl. He has also appealed against this decision.
