The Allahabad High Court has granted anticipatory bail to Sushil Singhania, the accused named in the Atul Subhash suicide case, giving relief from arrest. The single bench of Justice Ashutosh Srivastava granted four weeks’ anticipatory bail to the High Court in view of his advancing age and illnesses. Within four weeks, Sushil Singhania will have to seek relief from the competent court in the case registered in Bengaluru, Karnataka.
In the FIR filed by his brother Vikas Kumar in the case of suicide of Atul Subhash, the deceased’s wife Nikita Singhania, mother-in-law Nisha Singhania, brother-in-law Anurag Singhania along with cousin father-in-law Sushil Singhania have also been named accused. Bengaluru Police has arrested Nikita, Nisha and Anurag Singhania and sent them to jail. Bengaluru Police was looking for Sushil Singhania in this case.

While granting anticipatory bail, the Allahabad High Court put a condition that Sushil Singhania will not leave the country without informing the court and he will have to submit his passport to the Jaunpur Superintendent of Police. Along with this, Allahabad High Court granted relief to Sushal Singhania from arrest with two personal bonds of Rs 50 thousand each and two sureties.

Earlier, Sushil Singhania, uncle of Atul Subhash’s wife Nikita Singhania, had issued a video message saying that through the media I came to know that my name is also registered in the FIR. However, I am not associated with this matter. This matter has been going on for the last three years and since then I have not met these people.

According to a Bengaluru Police official, Nikita Singhania was arrested in Gurugram in Haryana, while her mother, Nisha Singhania, and brother Anurag Singhania were arrested in Prayagraj in Uttar Pradesh. All of them are accused of instigating Atul Subhash to commit suicide. He was detained on 14 December, brought to Bengaluru and sent to judicial custody for 14 days after being produced in a local court.
In the Allahabad High Court, senior lawyer Manish Tiwari argued that since Nikita, Nisha and Anurag had already been arrested, the anticipatory bail petition has been filed only on behalf of Sushil Singhania. It was argued on behalf of the lawyer that the above arrests were based on a suicide note and a video which had circulated online. Advocate Manish Tiwari said that 69-year-old Sushil Singhania is suffering from chronic medical problems, is incompetent and cannot instigate anyone to commit suicide.

The lawyer further argued that there is a difference between harassment and instigation. He said that even if the court takes cognizance of Atul Subhash’s suicide note, the allegations would be of harassment rather than instigation. He also said that Section 108, 3(5) of BNS cannot be applicable to the case. After hearing the arguments, Justice Ashutosh Srivastava ruled that after hearing the arguments of the defense, the court is of the opinion that the applicant Sushil Singhania is entitled to get anticipatory bail.
